Is your Will, right for you? Does it need review?

We often make a Will, store it away and then never think about it again. However, we should be reviewing our Will frequently to ensure that it still meets our requirements and reflects our wishes.

A significant life event can completely change the way in which your Will should be drafted. Below are some examples of things to consider:

  • Marriage-revokes your Will
  • Cohabiting couples-there is no such thing as common law marriage.  Protect your partner properly under your Will
  • Having children/another child/grandchild-Are these included?  Have you appointed guardians in your Will?
  • Divorce-have you properly protected your estate?
  • Buying a property-Is your property protected? Protect against care fees
  • Children from a previous relationship?- Are they properly protected in your Will
  • Legal changes-these can affect your Will. Eg. Since 9th October 2007 you have been able to transfer nil rate band between spouses which means that often nil rate band discretionary trusts set up before that date are no longer required and survivorship clauses are also often no longer the best advice.
